XII § 8 Intervention in Constitutional Questions

If a court case questions whether a state law is constitutional, and that case reaches the Louisiana Supreme Court through a certification process, the state needs to have a chance to weigh in, even if it's not already part of the lawsuit. This rule makes sure that happens.

Specifically, if the law being questioned affects the public interest, and the State of Louisiana isn't already a party to the case, the Supreme Court must notify the Attorney General's office. The state then has the right to step into the case, but only for the purpose of addressing the constitutional issue. This means the state can file written arguments and speak during oral arguments on that specific question.

This rule exists because laws passed by the legislature affect everyone, not just the people directly involved in a particular lawsuit. If a law might get struck down or upheld based on constitutional grounds, the state has a real interest in defending it or explaining its position, even in cases where the state wasn't originally sued or involved.
