XXVIII § 1 Review Guidelines

When someone is sentenced to death in Louisiana, the Supreme Court automatically reviews that sentence. The court doesn't wait for the person to ask for an appeal. This review happens every single time, to make sure the death penalty is being applied fairly.

The court looks at three main things during this review. First, it checks whether anger, bias, or other unfair influences played a role in the sentence, rather than a fair look at the facts. Second, it makes sure there was enough evidence to support at least one "aggravating circumstance," which is a legal factor that makes a crime serious enough to qualify for the death penalty. Third, the court compares the sentence to other similar cases, looking at both the crime itself and the person who committed it, to see if the punishment fits.

This process acts as a safety check. It helps make sure death sentences aren't hand down randomly or unfairly compared to how similar cases are handled. If the court finds problems with any of these three areas, it can change the sentence.
