Rule 130.11 Rehearing Before Commissioner

If a judge is not satisfied with how a case was handled by a commissioner, the judge can send the case back for a new hearing. Either side in the case can ask for this, or the judge can decide to do it without anyone asking. When the judge sends the case back, they can give the commissioner specific instructions on what to look at or how to handle it.

Once the commissioner holds this new hearing and makes new findings or recommendations, those results get treated just like the original ones did. This means the same review process applies again. The case does not skip any steps just because it has already been through a hearing once before.
