§ 1066 Successive motions

If a request made under section 1062 gets turned down, the person can't just ask again right away. They have to wait 90 days before making the same request again.

There's one exception. If the judge's written decision specifically says the person can try again sooner, then they don't have to wait the full 90 days. Otherwise, the 90-day waiting period applies automatically.

This rule stops people from repeatedly filing the same motion over and over hoping for a different answer. It gives some breathing room after a decision, so courts aren't flooded with the same request right after they already said no.
