§ 581-302 Status of donor

If someone donates sperm, eggs, or embryos to help another person have a child through assisted reproduction, that donor is not considered the child's legal parent. This applies as long as there is proof that the donor intended to simply donate, not to become a parent. That proof of intent is spelled out in a related section of the law, section 581-202(d).

In simple terms, this rule protects donors from being held responsible as a parent later on. If someone donates genetic material with the clear understanding that they are just helping someone else start a family, the law backs that up. They won't be on the hook for child support, custody, or other parental duties, as long as the donation was made with the right kind of documented intent.

This matters for both donors and the people receiving donations. Donors can feel secure knowing they won't accidentally become legal parents. And parents who use donated sperm, eggs, or embryos can be confident that the donor has no legal claim to the child, as long as everything was set up properly from the start.
