§ 581-303 Parentage of child of assisted reproduction

When a child is born through assisted reproduction, like using donated sperm, eggs, or embryos, the law says the person who intended to be a parent is the legal parent. This is true if that person either provided the genetic material or agreed to the process, as long as they meant to raise the child as their own and had the proper consent from the person carrying the pregnancy.

If someone wants official legal recognition of this parent-child relationship, they can ask the court for it. Anyone who has the legal right to file this kind of request can bring it to the court, and the judge will issue a formal ruling confirming that person as the legal parent.

This rule matters because it protects parents who use fertility treatments or donor help to have children. It makes sure that the person who planned to be a parent and agreed to raise the child gets full legal recognition, with all the same rights and responsibilities as any other parent.
