§ 581-607 Termination of surrogacy agreement

Anyone who agrees to be a surrogate can back out of the agreement before she becomes pregnant. This means she has the right to change her mind at any point up until the pregnancy actually starts through assisted reproduction.

Once she becomes pregnant, this particular right to cancel the agreement no longer applies. So the window for backing out is limited to the time before the pregnancy begins, giving the surrogate control over her decision up until that key moment.

This rule protects the surrogate by making sure she isn't locked into the arrangement once she has second thoughts, as long as she raises those concerns before pregnancy occurs. It gives her the final say in whether to move forward with the process, even after signing the agreement.
