§ 745 Evidence in dispositional hearings; required quantum of proof

When a family court judge decides what should happen after a case (like what services, placement, or orders are needed), they can only look at evidence that actually matters to the decision. Evidence that has nothing to do with the issue at hand, or that isn't reliable, doesn't belong in the hearing.

The judge also has to use a specific standard when making the final decision. This standard is called "preponderance of the evidence." It means the judge has to believe something is more likely true than not true, basically anything over a 50% chance. This is a lower bar than "beyond a reasonable doubt," which is used in criminal cases. It's the same standard used in most civil court cases.

For families involved in these hearings, this means the judge's decision doesn't need absolute certainty. The judge just needs to find that the evidence tips the scale, even slightly, in one direction. But that evidence still has to be relevant and material to the case, so both sides can expect the hearing to stay focused on what truly matters for the outcome.
