Rule 10 Powers of Investigator

(a) General Powers. The Investigator shall have the power to receive information, investigate, take informal remedial action, issue subpoenas and make recommendations to the Supreme Court concerning allegations against judges of willful misconduct in office, persistent failure or inability to perform judicial duties, habitual intemperance, disability, and/or violations of the NMI Code of Judicial Conduct.
(b) Witness Expenses. Per diem and mileage to witnesses may be paid at the rate specified in the Judicial Branch Travel Policy for the time which attendance is required. Witnesses may apply to the Supreme Court for reimbursement of per diem expenses and mileage after completion of their participation in disciplinary proceedings.
(c) Contempt Powers. The Investigator may initiate contempt proceedings before the Supreme Court if a witness or the Subject Judge fails to comply with any order of the Investigator in connection with a judicial disciplinary proceeding.
