Rule 6 Filing a Complaint

Any person or organization may file a complaint against a judge. The complaint shall be in writing, include the name and signature of the Incapacity proceedings to determine whether a judge suffers from a physical or mental condition shall not follow the procedures applicable to disciplinary proceedings. A determination of incapacity is not a disciplinary action. Rather, the purpose of such a proceeding is to assess whether the judge has a physical or mental condition that adversely affects their ability to perform judicial duties. See Section VII below.

Complaint forms are available in the Supreme Court Office of the Clerk of Court, but a Complaint may also be made by letter detailing the name of the judge involved, a detailed description of the alleged conduct or disability, relevant dates, and any supporting documentation. Upon receipt, the Clerk of Court will forward the Complaint to the Chief Justice of the Supreme Court. If the complaint is against the Chief Justice, it shall be directed to the next most senior justice of the Supreme Court.
