Rule 7 Initial Screening

The Chief Justice or a designee Justice will examine the complaint.

(a) Dismissal. If the complaint is frivolous, unfounded, solely appellate in nature, or outside the jurisdiction of the court, it shall be dismissed without further investigation. Notice of the dismissal shall be promptly served to the complainant.

(b) Appointment of Investigator. If the complaint is not frivolous, not unfounded, not solely appellate in nature, or not outside the jurisdiction of the court based on reasonable grounds, the Chief Justice or designee Justice will appoint an Investigator within forty-five (45) days of receiving the complaint. If all of the currently sitting Justices recuse, then a justice pro tempore shall be appointed for the purpose of appointing the Investigator. The complaint shall be assigned a case number and sealed as confidential.
