§ 1108 Suit by surety before liability due.

If you agreed to be a surety (meaning you promised to pay someone else's debt if they don't), this rule gives you a way to protect yourself before that debt is even due. Normally you'd have to wait until the debt comes due to take action. But if the person you're backing up shows signs of trying to skip out on the debt or hide their assets, you don't have to wait.

Specifically, if there are grounds that would let a court issue an arrest and bail order, or an attachment order, against that person, you can go to court right away. You can sue them for indemnity, which means asking the court to make sure you're protected or reimbursed for the debt you're on the hook for.

This rule exists because it's not fair to make a surety sit back and do nothing while the person they backed is actively trying to avoid paying or is hiding money. It gives the surety a legal option to step in early and protect their own financial interest before they actually have to pay out on the debt.
