Rule 733 Claim Is a Release of Damages

When someone makes a claim for property that was seized by a court officer, they give up their right to sue that officer for any damages related to the seizure.

This means you have to make a choice. If you want the property back, you file a claim for it. But by doing that, you cannot also sue the officer who took the property for money damages. You cannot pursue both options at the same time.
