When you are sued and the other side files a counterclaim against you, you can respond to that counterclaim just like the original defendant would respond to a lawsuit. The same basic rules for filing a defense apply to you.

If the defendant has to swear under oath that certain facts in their defense are true, then you have to do the same thing when you raise those same types of defenses. Both sides are held to the same standard when it comes to sworn statements.
