Rule 82 Special Defenses

If a defendant brings up a special defense in their court filing, the person suing them does not need to write a formal response denying it. The court automatically treats it as denied.

This means the defendant cannot assume their defense is accepted just because the plaintiff stayed silent about it. The only way a special defense is considered accepted is if the plaintiff clearly and directly says so in writing.
