Rule 82 Special Defenses

When a defendant raises a special defense in their court papers, the plaintiff does not have to file anything extra to dispute it. The court automatically treats the defense as denied, meaning the plaintiff is already considered to be disagreeing with it.

This saves the plaintiff from having to respond to every defense the defendant raises. The only exception is if the plaintiff actually wants to agree with the defense, in which case they must clearly say so in writing.
