Art. 3514 Release not to affect right to damages

If your property gets seized in a lawsuit, you have the option to get it released by putting up security (like a bond). This rule says that doing so does not give up your right to fight back later.

Even after you get your property released, you can still argue in court that the seizure was illegal or improper in the first place. You also keep your right to sue for damages if the seizure turns out to have been wrongful. In short, posting security to get your stuff back does not mean you're agreeing the seizure was legal or giving up your right to be compensated if it wasn't.
