IX § 3 Briefing and Oral Arguments

When the Louisiana Supreme Court agrees to rehear a case, judges may set a special date for both sides to argue their case out loud in person. This doesn't happen automatically for every rehearing, but the Court can choose to schedule it.

If your case is granted a rehearing, you should not plan on filing new written arguments. The Court will not accept extra briefs unless it specifically tells you to submit one. In other words, the lawyers cannot just send in more paperwork because they want to add new points or explain their side further. They have to wait for the Court to ask for it.

This rule keeps the rehearing process focused and efficient. It stops cases from dragging on with endless rounds of new documents. If the Court wants more information from either side, it will let the parties know directly.
